What is an interim or employment agency?

A temporary employment agency is the Dutch name for the Flemish temporary employment agency, so both words mean exactly the same. A temporary employment agency makes an appointment with an employer who is looking for new workers. The office then searches its database of job seekers for the people who best match the profile of the vacancy. The people in the interim office’s database must register themselves with that office. Everyone can register as often as they want and it is completely free.

Who pays an interim worker?

An interim worker, or a person employed through a temporary employment agency, is paid by the temporary employment agency itself. The employer must transfer a certain amount of money every month to the temporary employment agency, which then ensures that the temporary workers are paid. In fact, an interim worker is not an employee of the place where he is employed, but of the temporary employment agency where he is registered.

After how many years can an interim worker get a permanent contract?

In Belgium it is mandatory to offer an interim worker an indefinite contract after two years of continuous employment. If an interim worker does not receive a contract for one week, the two-year period simply starts over again. In special circumstances such as an economic crisis, the employer may, in consultation with the trade union, extend those two years for a third year. After that third year, the employer is obliged to offer a contract of indefinite duration. If an indefinite contract is still not offered after three years, the employee can appeal to his trade union to enforce a contract.
